In this document, Boost Online BV has described the following sections: privacy, intellectual property and disclaimer. These topics apply not only to the Boost Online BV website, but also to BoostYourClub, trade name of Boost Online BV.
Privacy statement Boost Online B.V.
1. Introduction
Boost Online B.V. is an (online) marketing agency that develops creative campaigns and results-oriented resources both online and offline. If a customer wants to purchase products or services, we need their personal data. Boost Online B.V. processes personal data carefully, securely and confidentially. We believe it is important that customers have confidence in our organisation. That is why we do everything we can to protect their privacy. The rules for protecting privacy are laid down in the General Data Protection Regulation (GDPR), with the Data Protection Authority (DPA) supervising compliance with the law. Boost Online B.V. acts within the framework of the law.

What is personal data?
Personal data is any data that can be traced back to a person. Examples include names, addresses, telephone numbers and account numbers. Sometimes we aggregate or anonymise personal data so that it can no longer be traced back to individuals.
- Are customers required to provide personal data?
Sometimes we are literally obliged to store or provide certain personal data of customers. In many cases, it is necessary to use certain personal data in order to offer a service or product. In that case, the use of data is necessary for the agreement or the pre-contractual phase. The pre-contractual phase is, for example, the provision of login details.
2. What personal data do we collect and what do we use this data for?
Personal data can be divided into categories. We use the following categories of personal data from our customers:
2.1. Name, address and contact details
These are first names, initials, surname, gender, address, postcode, place of residence, email address, telephone number and date of birth. We use this data for:
- To send requested (free) downloads or to deliver an order placed via our website.
- To process your order and keep you informed about its progress.
- To process your subscription to our mailing list.
- To communicate with you by sending digital newsletters.
- To communicate with you about your request for an introductory meeting or interest in one of our services.
- To answer your questions by email or telephone.

The processing of this data is necessary for the performance or conclusion of a contract or to comply with a legal obligation. We have a legitimate interest in investigating the quality of our services, namely to obtain the knowledge necessary to improve our services.
3. Cookie statement
Boost Online B.V. uses Google Analytics cookies for website measurements. These only track which pages are visited; no statistics or data about the visitor are stored.
4. Do we share the data with other parties?
Boost Online B.V. never shares personal data without permission unless required to do so by law. We only pass on the data you provide to third parties if this is necessary for the delivery of the products you have ordered or the services you have requested. This could be a postal company that collects, transports and delivers mail, for example. These organisations only receive the necessary data, such as the address and, if applicable, a telephone number or email address for making an appointment.
In addition, Boost Online B.V. uses a number of software programmes that allow suppliers to access personal data. The suppliers are our processors. This means that we have entered into a processing agreement with them. This agreement sets out their responsibilities when processing personal data.
Boost Online B.V. ensures that data exchange complies with legal requirements. This includes taking organisational and technical measures to assure customers that their privacy is guaranteed.
5. Will your data be transferred outside the EU?
Boost Online B.V. only uses personal data within the EU. Since the GDPR applies within the EU, personal data is always adequately protected in principle.
6. How do we protect your data?
All persons employed by Boost Online B.V. or performing work on behalf of Boost Online B.V. who need to use personal data for this purpose are bound by a duty of confidentiality. This does not apply if their duties or a legal requirement oblige them to disclose such information. They only have access to information to the extent that this is necessary for the performance of their duties; other information is not provided to them. We also take technical and organisational measures to secure data so that it cannot be lost and is not processed without reason. We ensure that organisations with whom we share personal data adhere to the same standards. If, despite our security measures, something goes wrong and this has disadvantages for customers, we will inform them as soon as possible.
7. How long do we retain data?
We do not retain data for longer than is legally permitted and necessary for our services. How long certain data is retained depends on the nature of the data and the purposes for which it is processed. The retention period may therefore vary depending on the purpose. Once the retention periods have expired, we destroy the data.
8. What rights do customers have based on the processing of personal data?
Boost Online B.V. considers it important that customers are able to exercise their rights under the law. Customers have the following rights:
- The right of access: the right to access the personal data we process about a customer;
- The right to data portability: at a customer’s request, we must transfer all personal data we hold about them to the customer or another organisation of their choice. Customers can only exercise this right if the data is processed on the basis of consent or an agreement.
- The right to be forgotten: if we no longer need the personal data for the purpose for which we received it, a customer has the right to ask us to delete it.
- The right to rectification and supplementation: if personal data that we process about a customer is incorrect or incomplete, the customer has the right to have it corrected.
- The right to restriction of processing: during the period that we are:
- To determine whether the customer’s data needs to be rectified;
- To determine whether the data processing is unlawful;
- To determine whether the data should be deleted;
- Or if the customer has objected to the processing, the customer has the right to request the restriction of the processing;
- The right to object to data processing: if we process data on the basis of legitimate interest or public interest, it is possible to object. A balancing of interests will then take place;
- The right relating to automated decision-making and profiling. This means that we must always take a human perspective when making decisions.
Would you like to exercise one of these rights? You can indicate this by email (info@boostonline.nl) or by letter (Niewstraat 5a, 5571 BA Bergeijk). This request must clearly state which right the customer wishes to exercise. After receiving the request, we will inform the customer within 4 weeks whether we can comply with the request.
9. Submitting a complaint to the competent authority
Boost Online B.V. considers it important to have satisfied customers. Even though we do everything we can to achieve this, it is possible that a customer may not be satisfied. It is possible to submit a complaint to the Dutch Data Protection Authority if it concerns the protection of personal data. 11. Changes to this privacy statement Boost Online B.V. reserves the right to make changes to this privacy statement. Any changes will remain within the limits of the relevant legislation. All changes will be published on the website www.boostonline.nl.
Intellectual property
All intellectual property rights to the content of the services and websites of Boost Online BV and BoostYourClub, such as software, texts, images and sounds, are owned by Boost Online BV. Permission must be requested in writing or by email before publishing content from the websites of Boost Online BV and BoostYourClub.
